End User License Agreement & Terms of Sale

FLAIR SIM — Version 1.1 · Effective 13 October 2026

READ THIS AGREEMENT CAREFULLY. IT IS A LEGALLY BINDING CONTRACT. BY TICKING THE ACCEPTANCE BOX, COMPLETING A PURCHASE, DOWNLOADING, ACTIVATING, OR USING THE SOFTWARE, YOU ("YOU", THE "LICENSEE") AGREE TO BE BOUND BY EVERY TERM BELOW. IF YOU DO NOT AGREE, DO NOT PURCHASE, DOWNLOAD, ACTIVATE, OR USE THE SOFTWARE.

This End User License Agreement and Terms of Sale (the "Agreement") is entered into between FLAIR SIM, an independent project, contact hello@flair-sim.com ("FLAIR SIM", "we", "us", the "Licensor"), and you, the individual or entity purchasing or using the Software.

1. Definitions

  1. "Software" / "Product" means the FLAIR SIM add-on aircraft (including, without limitation, the FLS 787-8), together with all of its components: 3D models, meshes, geometry, textures, liveries, sounds, code, plugins, scripts, configuration, documentation, and any updates, patches, or additional content.
  2. "Assets" means all copyrightable and proprietary elements of the Software, in any form (encrypted, decrypted, in memory, on disk, in graphics memory, or as rendered output), including the geometry and textures.
  3. "Activation" means the online licensing, hardware-binding, and asset-delivery mechanism required to unlock and run the Software.
  4. "License Key" / "Serial" means the unique code issued to you upon purchase.
  5. "Protection Measures" means all technical protection, encryption, activation, watermarking, hardware-binding, and anti-tamper mechanisms in or applied to the Software.

2. Acceptance & Eligibility

  1. To enter into this Agreement you must have reached the age of legal majority where you live. If you have not, you may buy and use the Software only with the consent of a parent or legal guardian, who accepts this Agreement on your behalf and is responsible for your compliance with it, including Sections 6 to 8. If you accept on behalf of an entity, you warrant that you are authorised to bind it.
  2. Acceptance of this Agreement is a condition of purchase. Your acceptance, its version, and its date and time are recorded at checkout and form part of the contract.

3. Grant of License

  1. Subject to your full and continuing compliance with this Agreement and to payment in full, the Licensor grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Software for your own private, non-commercial flight-simulation use, on one (1) personal device registered through Activation. If you replace your computer, contact us and we will reset the registration.
  2. This is a license, not a sale of the Software or the Assets. All rights not expressly granted are reserved by the Licensor.
  3. Permitted personal media. You may capture and publish non-commercial screenshots and video of the Software in normal simulator use (e.g., streaming or video of your flights), provided you do not thereby distribute, expose, or enable extraction of the Assets or any Protection Measure, and you do not present the Assets as your own.

4. Ownership & Intellectual Property

  1. The Software and all Assets are owned by the Licensor and/or its licensors and are protected by copyright, trade-secret, and other intellectual-property laws and international treaties. You acquire no ownership of the Software or Assets.
  2. All trademarks, logos, and trade names are the property of their respective owners. Aircraft type designations and manufacturer names are used for identification and compatibility only and do not imply endorsement. FLAIR SIM is an independent product and is not affiliated with, endorsed or sponsored by The Boeing Company. Boeing, 787 and Dreamliner are trademarks of The Boeing Company. X-Plane is a trademark of Laminar Research.

5. Activation, Hardware Binding & Asset Delivery

  1. The Software requires online Activation at each launch. It binds to the hardware of your registered device and may download protected Assets from our servers. An internet connection is required to run the Software.
  2. Each License Key permits Activation on a limited number of devices. Attempts to exceed that limit, to activate on additional or unauthorised machines, or to share the License Key are logged and may result in denial of Activation and revocation.
  3. You consent to the operation of the Protection Measures, including the transmission of a hardware identifier and the creation on your device, at Activation, of a cryptographic device key held in its security chip (TPM) where available, whose private part never leaves your device and whose public part is registered with your License Key, for the sole purposes of licensing and anti-piracy enforcement (see Section 13).
  4. The Licensor may suspend a License Key while it investigates a reasonable suspicion of piracy, fraud, or license sharing, and may revoke it, and refuse Activation or asset delivery, without refund, where a material breach of this Agreement, piracy, chargeback, fraud, or license sharing is established. Revocation is always decided by a person; you can contest it by writing to us.

6. Restrictions — Prohibited Conduct

You shall not, and shall not permit or assist any third party to, directly or indirectly:

  1. Distribute or share. Copy, publish, upload, share, post, transmit, distribute, sell, resell, rent, lease, lend, sublicense, assign, transfer, or otherwise make the Software or any Asset available to any third party, in whole or in part, by any means — including file-sharing networks, torrents, cyberlockers, forums, chat groups, or private transfer.
  2. Reverse engineer or crack. Reverse engineer, decompile, disassemble, decrypt, deobfuscate, debug, or otherwise attempt to derive source code, algorithms, keys, or the structure of the Software or its Protection Measures; or develop, use, or distribute any crack, patch, keygen, loader, emulator, or tool intended to do any of the foregoing.
  3. Circumvent protection. Bypass, disable, defeat, interfere with, or circumvent any Protection Measure, Activation, licensing, hardware binding, or watermark, by any means.
  4. Extract Assets. Extract, rip, dump, capture, intercept, copy, or reconstruct any Asset — including any 3D model, mesh, geometry, or texture — from disk, from system or graphics memory (RAM/VRAM), from network traffic, from the filesystem, or by means of graphics debuggers, frame capture, memory dumping, hooks, or any similar technique.
  5. Tamper with identifiers. Remove, alter, obscure, or falsify any copyright notice, trademark, watermark, per-purchaser identifier, License Key, or other proprietary or tracking marking.
  6. Repurpose Assets. Use, import, convert, port, adapt, or incorporate any Asset into any other product, aircraft, add-on, simulator, game, engine, model library, 3D-printed object, dataset, or machine-learning / AI training corpus; or create derivative works from any Asset.
  7. Commercial exploitation. Use the Software or Assets for any commercial purpose other than the personal simulator use expressly permitted in Section 3.
  8. Enable others. Publish, document, or share any method, instruction, key, or tool that enables any of the foregoing.
  9. Attack our systems. Access or attempt to access our servers, the Activation service, or their data without authorisation; scan, probe, or test them for vulnerabilities; emulate, spoof, redirect, or replace the Activation server; intercept, replay, or modify its traffic; attempt to guess, generate, or enumerate License Keys; or overload or disrupt the service.
  10. Use unauthorised copies or keys. Install or use a cracked, modified, or unauthorised copy of the Software, or a License Key that was not issued to you by FLAIR SIM (including keys obtained from resellers, key-sharing, or leaked lists).

Each of the foregoing prohibitions is a material term. To the maximum extent permitted by applicable law, the restrictions on reverse engineering apply notwithstanding any interface or interoperability exception, except to the narrow extent such exception cannot be excluded by contract.

7. Per-Purchaser Watermarking & Traceability

  1. You acknowledge and agree that copies of the Software and its Assets are individually and invisibly watermarked and marked with identifiers unique to your purchase, and that our servers log Activation and delivery events.
  2. Any copy or Asset found to have been distributed, leaked, extracted, or made available in breach of this Agreement may be traced back to your purchase. You consent to this tracing and to its use as evidence in any enforcement or legal proceeding.

8. Enforcement, Termination & Remedies

  1. This Agreement and the license terminate automatically and immediately, without notice and without refund, upon any material breach, including any breach of Sections 6 or 7. Upon termination you must cease all use and permanently delete all copies of the Software and Assets in your possession or control.
  2. Breach of Sections 6 or 7 causes serious and irreparable harm for which monetary damages alone are inadequate. The Licensor is entitled to seek injunctive and equitable relief in addition to all other remedies, without the requirement to post bond.
  3. You shall be liable for all losses arising from your breach, including lost sales, diminution in value of the Assets, the costs of investigation and enforcement, and reasonable legal fees, to the fullest extent permitted by law.
  4. All licenses and future purchases. Where a breach of Sections 6 or 7 is established, the Licensor may revoke every License Key held by you or obtained to circumvent the revocation, and refuse any future sale to you.
  5. Protection under the law, not only this Agreement. Unauthorised copying and distribution of the Software, and the circumvention of its Protection Measures, are unlawful under copyright law independently of this Agreement (including, in the EU, Directives 2001/29/EC and 2009/24/EC and, in the United States, 17 U.S.C. §§ 106 and 1201), and unauthorised access to computer systems is a criminal offence in most countries. The Licensor will pursue all civil and criminal remedies available, including damages, recovery of legal costs, and criminal complaints.
  6. The Licensor may report violations to, and cooperate with, payment providers, platforms, hosting providers, and law-enforcement or judicial authorities, and may issue takedown notices (including DMCA notices) against infringing copies, cracks, and the sites and accounts that distribute them. For this purpose it may disclose the purchase and Activation records linked to the infringing License Key.
  7. No failure or delay in exercising any right is a waiver of it.

9. Purchase, Price & Delivery

  1. The price, currency, and any applicable taxes are shown at checkout. Payment is processed by our third-party payment provider; you agree to their terms in respect of the payment.
  2. Following successful payment, a License Key is delivered to the email address you provide. You are responsible for providing a correct email address and for keeping your License Key confidential.

10. Right of Withdrawal & Refunds (Digital Content)

  1. The Software is digital content supplied electronically. Where you are a consumer with a statutory right of withdrawal (e.g., the 14-day right under EU/EEA law), that right is lost once supply has begun — namely when your License Key is issued and the Software is made available to you, immediately after payment — where you have given prior express consent to immediate supply and acknowledged that you thereby lose the right of withdrawal.
  2. By ticking the acceptance box before paying, you expressly request immediate supply and acknowledge that you lose your right of withdrawal as soon as your License Key is issued. You receive a confirmation of this consent by email together with your License Key.
  3. Accordingly, all sales are final and non-refundable once your License Key has been issued, except where you are entitled to a remedy because the Software is not in conformity with its description, or as otherwise required by mandatory law. No refund is due where a license is revoked or terminated for breach.

11. Updates & Support

  1. The Licensor is not obliged to release updates, new versions, new features, or compatibility updates for future versions of the simulator, nor to provide support. Any update or support it chooses to provide is at its discretion and subject to this Agreement. Where you are a consumer in the EU/EEA, this does not affect any update that mandatory law requires to keep the Software in conformity with its description.
  2. The Licensor may change the Software, the Activation service, or asset delivery for valid reasons (such as security, compatibility with the simulator, or legal requirements). Where a change negatively affects your use of the Software more than marginally, you will be informed in advance and have the rights granted to you by mandatory consumer law.
  3. The Software depends on third-party platforms (including the flight simulator). The Licensor is not responsible for changes to those platforms that affect the Software.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE OR ACTIVATION WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ALL TIMES. Nothing in this Agreement excludes or limits any warranty or right that cannot lawfully be excluded or limited, including mandatory consumer rights.

13. Data Protection & Privacy

  1. To operate licensing and anti-piracy, the Licensor processes your email address, License Key, a hardware identifier of your device, the public part of the device key created at Activation, and Activation/delivery logs. The legal bases are performance of this contract and the Licensor's legitimate interest in preventing piracy and enforcing its rights.
  2. This processing, and your rights under the GDPR, are described in the Privacy Policy.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT. THE LICENSOR'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Nothing in this Agreement limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable law. These limitations do not affect mandatory consumer rights.

15. Governing Law & Jurisdiction

  1. This Agreement is governed by the law applicable under the rules of private international law, excluding the United Nations Convention on Contracts for the International Sale of Goods.
  2. Where you are a consumer, nothing in this Agreement deprives you of the protection of the mandatory law of your country of residence, and you may bring proceedings before the courts of the place where you live.

16. Changes to this Agreement

The Licensor may update this Agreement for future purchases and for the continued operation of the Activation service. The version in force at the time of your purchase governs that purchase; material changes affecting continued use will be notified by reasonable means.

17. General

  1. Entire agreement. This Agreement, together with the Terms & Conditions of flair-sim.com, is the entire agreement between the parties regarding the Software and supersedes all prior understandings. If they conflict, this Agreement prevails.
  2. Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force.
  3. Assignment. You may not assign or transfer this Agreement or the license. The Licensor may assign it in connection with a merger, acquisition, or sale of assets.
  4. No third-party beneficiaries. Except for the Licensor's licensors, this Agreement creates no third-party rights.
