These terms govern your use of flair-sim.com and its mailing list. Purchases of FLAIR SIM products are governed by the End User License Agreement & Terms of Sale (the "EULA"), which you accept before paying; the main points are summarised below. If the two documents conflict, the EULA prevails for purchases.
flair-sim.com is run by FLAIR SIM, an independent project. Contact: hello@flair-sim.com.
You can sign up with your email address to receive news about our products. Your signup is complete only after you confirm the link we send you. You can unsubscribe at any time with the link in every email. We use your address only as described in our Privacy Policy.
Our products are add-on aircraft for X-Plane 12, sold as digital content. If you are under the age of majority where you live (18 in most countries), you need the consent of a parent or guardian, who accepts the EULA on your behalf. What you buy is a personal, non-transferable licence to use the software, not ownership of it; the licence terms are in the EULA.
Requirements. A licensed copy of X-Plane 12 on a compatible computer, and an internet connection every time the aircraft is loaded: the licence is checked online at each launch and is tied to a limited number of devices, as stated in the EULA.
Price and payment. The price is shown on the product page; the final amount, including VAT or other taxes applicable in your country, is shown on the checkout page before you pay. Payment is processed by Stripe; we never receive your full card details.
Zero tolerance for piracy. Every copy is watermarked and traceable to the licence it was delivered to. Sharing, cracking or distributing the aircraft or its files, using a key that was not sold to you, or attacking the licence server leads to revocation of all your licences without refund and to civil and criminal action, as set out in sections 5–8 of the EULA.
Contract and delivery. The contract is concluded when your payment is confirmed. Your licence key is then shown on the confirmation page and sent to the email address you entered at checkout, together with a confirmation of your purchase and of the consent described below.
If you are a consumer in the EU, you normally have 14 days to withdraw from a distance purchase. For digital content supplied immediately, that right ends once supply has begun — that is, when your licence key is issued and the software is made available to you, immediately after payment — provided you have expressly asked for immediate supply and acknowledged that you lose the right of withdrawal. You give that consent by ticking the box on the purchase page, which is required to buy, and we confirm it by email together with your licence key. As a result, purchases are final and cannot be withdrawn from.
Losing the right of withdrawal does not affect your statutory rights if the product is not as described or does not work as it should (legal guarantee of conformity for digital content under EU Directive 2019/770 and the national laws implementing it). If you have a problem, contact us at hello@flair-sim.com and we will repair the defect, or, where that is not possible, reduce the price or refund you as the law provides.
We are not obliged to release updates, new versions, new features or compatibility updates for future versions of X-Plane; anything we release is at our discretion. If you are an EU consumer, this does not affect the updates the law requires to keep the product in conformity with its description. Questions can be sent to hello@flair-sim.com.
Content on this site is for information. Product features, screenshots and dates shown before release are subject to change during development. You may not use the site in a way that disrupts it or attempts to access the licence system or its data without authorisation.
To the fullest extent permitted by law, we are not liable for indirect or consequential damages arising from your use of this site. Nothing in these terms limits liability for intent or gross negligence, or rights that cannot be limited under applicable consumer law.

We may update these terms; the version in force when you make a purchase applies to that purchase. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may bring proceedings before the courts of the place where you live.
